Is Rebet legal in Florida?

Key takeaways
- › Rebet is legal in Florida (18+).
- › Sweepstakes model = not classified as gambling under Chapter 849.
- › Free 'Alternative Method of Entry' (AMOE) is what makes it legal.
- › No conflict with the Seminole compact or Hard Rock Bet.
- › Florida has no state income tax on winnings.
- › Federal 1099-MISC applies over $600 in annual redemptions.
Why the sweepstakes model is legal
Florida Statute Chapter 849 defines gambling as three things happening together: consideration (money in), chance (a random outcome), and prize (money out). Remove any one leg and it's not gambling.
Rebet uses a two-coin system. Rebet Coins are play-only. Sweeps Coins can be redeemed for cash — but you never buy Sweeps Coins directly. You get them free as bonuses on Rebet Coin purchases, as daily login rewards, or by mailing in a written request (the AMOE). Because a free path exists, there is no legally required "consideration" and the whole system falls outside Chapter 849.

Rebet vs Kalshi legality in Florida
Both are legal, for different reasons. Kalshi is a CFTC-designated contract market — federal preemption over state gambling law. Rebet is a sweepstakes operator — sits outside state gambling law by design. Neither requires a Florida gaming license, and neither is affected by the Seminole compact.
